Burglary And Theft Related

Mr. Ham recently defended a client accused of felony strike residential burglary, vehicle theft, and vandalism. Mr. Ham fought the case and the result was a dismissal of all felonies in exchange for a misdemeanor and no jail time. In another case, Mr. Ham's client was accused of felony commercial burglary with a prior burglary conviction. Mr. Ham resolved the case for a misdemeanor petty theft and dismissal of the felony burglary.
Burglary can be charged in the first and second degree. A burglary is considered in the first degree if the crime was committed in a home. A first degree or a residential burglary is a strike. Second degree burglary is the burglary on a non-residential structure or vehicle.
Theft cases can be charged in many forms. Petty theft is the stealing of items worth less than $400.00. Grand theft is the stealing of items worth more equal to or than $400.00. If a person accused of petty theft has a prior theft conviction, the charge can be brought as a felony; petty theft with a prior.
